Family Provision claims have made Estate Planning more complex in recent times. Having a valid Will in place won't prevent claims being made against your Estate. However, if you receive sound advice before preparing your Will, it can help to minimise stress for your family after your death.

An invalid Will may also prevent an application for a Grant of Probate being approved by the Supreme Court after your death.  

For simple Estates, it can be tempting to prepare your own Will and this may be adequate in many situations. We recommend you obtain advice prior to preparing your own Will to understand what your Estate assets are, and to ensure that your Will is valid.

Testamentary Trusts are often valuable for business owners, blended families or anyone potentially involved in family law proceedings. If minor children stand to inherit your Estate, there are also significant tax benefits as a result of creating a Testamentary Trust in your Will.

In addition to Wills, we also prepare Enduring Power of Attorney and Enduring Power of Guardianship documents. Executing these documents allow you to continue to manage your own affairs now. However, if you lose your capacity to do so for any reason, these documents will also ensure someone trusted steps into this role.
